User Agreement

The following describes the terms on which FirehawkCash.com offers you access to our services.

Welcome to Firehawk Cash. By using Firehawk Cash (including FirehawkCash.com and
its related sites, services and tools), you agree to the following terms with Firehawk Cash.
If you have any questions, please refer to our support section.

This Agreement is effective on November 30, 2009, for current users, and upon acceptance for new users.

Eligibility

You must be 14 years of age or older to participate. FirehawkCash.com is open to US and International members and is void where prohibited by local governing laws.

In an effort to ensure the integrity of the FirehawkCash.com advertising program, the persons in any of the following categories are NOT eligible to participate in the FirehawkCash.com program in the capacity of ad viewer: (a) persons who are employees or agents of FirehawkCash.com, or its respective parents, subsidiaries, affiliated companies, or service agencies, or independent contractors of any of the above organizations; and (b) persons who are immediate family (defined as mother, father, sister, brother, daughter, son or spouse) of any person in any of the preceding categories, regardless of where they live. Nothing herein shall be construed to prohibit a person's right to maintain a Firehawk Cash account for advertising purposes nor does this policy restrict the promotion of a person's affiliate link.

Responsibility of members

You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing Firehawk Cash account. FirehawkCash.com is limited to one account per household.

You will use your email address / password combination to access your account and it is your responsibility to keep this information confidential. You are solely responsible for any and all use of your FirehawkCash.com account including authorization by you to any third party individual who may use your account. Any unauthorized access to your account should be reported immediately.

Should FirehawkCash.com detect any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal in the sole discretion of FirehawkCash.com, these actions may result in member termination and possible legal action as well as forfeiture of any earned commissions not yet disbursed to you from FirehawkCash.com.

Advertiser Requirements

Any advertisement submitted to FirehawkCash.com will automatically be activated. However FirehawkCash.com does not accept advertisements that discriminate or intend to discriminate on any illegal basis, or are otherwise illegal. Ads containing nudity, adult language or sexual content, drugs and drug paraphernalia, malicious script or code, excessive pop-ups, or viruses are prohibited. Advertising that promotes violence is not accepted. Advertising is not permitted for the promotion of online casinos and gambling activities. Advertising is not permitted for hacking or cracking and tools that aid in copywriters infringement. Any adult content (sexually themed material) shall be prohibited. In summary, and without being exhaustive, no sites promoting the follow shall be submitted to FirehawkCash.com. If your website violates our Advertiser Requirements, your account will be terminated with little or no warning, with loss of all credits.

• Adult Content
• Credit Cards
• Drugs, drug paraphernalia, and prescription drugs
• Firearms, weapons, and knives Discriminatory Practices
• Illegal Downloads
• Tobacco
• TV de-scramblers, radar scanners, and traffic signal control devices
• Wiretapping devices and telephone bugging devices

FirehawkCash.com reserves the right to reject advertisements at our sole discretion.

Abusing Firehawk Cash

FirehawkCash.com works with the Community to keep the site working properly and safe for users. Please report problems, offensive content, and policy violations to us.

Without limiting other remedies, we may limit, suspend or terminate our service and user accounts, prohibit access to our sites and its content, services and tools, delay or remove hosted content, and take technical and legal steps to keep users off the sites if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue Firehawk Cash sites, services or tools.

Content

When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, trademark, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future.

Fees and Services

Joining FirehawkCash.com is free. We do charge fees for using other services, such as buying Advertisements. When you use a service that has a fee, you have an opportunity to review and accept the fees that you will be charged, which we may change from time to time. We may also choose to temporarily change the fees for our services for promotional events (for example, free advertising days) or new services, and such changes are effective when we post the temporary promotional event or new service on the sites.

Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees and applicable taxes associated with our sites and services.

Refunds

We do not issue refunds for purchases made through our website. There may be certain circumstances where an error might have occurred, where we will issue a refund.

Payment Eligibility

All payments are in U.S. Dollars. In order to receive any payment from the FirehawkCash.com System, the member must meet the following requirements:

• all registration information you submit is truthful and accurate
• must be at least 14 years old
• have a valid PayPal or AlertPay email address
• have a balance of $2.50 or greater for upgraded members, and $5 or greater for free members
• free members must view at least 50 ads to cashout

PayPal & AlertPay is the system default payment processor

When you request payment, upgraded members will receive their payments within 24 hours, while free members will receive their payments net 15 days.
You are limited to one cashout per month!

Your account may be deleted and your Membership may be terminated without warning, if we believe that you are less than 14 years of age.
Each member is only allowed one account. If we believe that you have created multiple accounts, your membership may be terminated.

Inactive Accounts

Inactive accounts will not be deleted. However if your account is inactive for more than 60 days since your last login your balance will reset to $0. You may choose to delete your account at any time. If you decide to delete your account, you will lose all earnings/referrals associated with your account.

Membership Upgrades and Contests

You may upgrade your account at any time. Membership upgrades allow you to earn more money from ad views. If you select to have money deducted from your account, but do not have the necessary funds, you will be required to pay via PayPal or AlertPay to become a premium member. You may cancel your upgrade at any time, but doing so will result in a loss of all additonal earnings for each month in which your not a premium member.

Split the Pot Weekly Drawings are on Saturdays @12:00pm EST. Each week the winner will receive HALF of the Pot's earnings and will receive credit to their account balance. FirehawkCash.com is not responsible for any errors that may occur regarding upgrades or winnings.

Limitation of Liability

You will not hold FirehawkCash.com responsible for other users' content, actions or inactions, advertisements they list or their destruction of allegedly fake items. We are not involved in the actual transaction between advertisers and users. While we may help facilitate the resolution of disputes through various programs, we have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users' content or listings.

Release

If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the Firehawk Cash Privacy Policy. We view protection of users' privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. We use third parties to verify and certify our privacy principles. For a complete description of how we use and protect your personal information, see the Firehawk Cash Privacy Policy. If you object to your information being transferred or used in this way please do not use our services.

Indemnity

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.

No Agency

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

General

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement in accordance with the Notices Section. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of this Agreement.

This Agreement may not be otherwise amended except in a writing hand signed by you and us. For purposes of this provision, 'writing' does not include an email message and a signature does not include an electronic signature.

We may amend this User Agreement at any time by posting the amended terms on this site. All amended terms automatically take effect after they are initially posted on the site. In addition, we will notify you through the FirehawkCash.com Message Center.
